As used in this policy, the terms "using" and "processing" information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our organization or among our affiliates or internationally.
INFORMATION COLLECTION AND USE
We may use the Personal Information and the Non-Identifying Information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the Site, or use certain other site features in the following ways (the “Service”):
- To allow us to better service you in responding to your service requests.
- To quickly process your transactions.
- To send periodic emails regarding your Member’s order or other products and services, resolve disputes and/or troubleshoot problems.
- To perform analytics and conduct customer research;
- To verify your compliance with your obligations in our Terms of Services;
- To improve the quality of the Site and the Services;
PERSONALLY IDENTIFIABLE INFORMATION
When you register with us through the Site and become a Member and when you choose to post a Listing or book a Chef, or when you wish to contact another Member, we will ask you for personally identifiable information. This refers to information about you that can be used to contact or identify you (“Personal Identity Information”). Personal Identity Information may include, but is not limited to, your name, email address, mailing address, phone number or other details required to provide you with the Services. In order to process some of your transactions through the Site, we may also ask for your credit card number and other billing information (“Billing Information”) (Personal Identity Information and Billing Information together, “Personal Information”).
We collect Personal Information from you when you register on our Site, place an order or enter Personal Information on our site.
You can also register to join by logging into online accounts you may have with third party service providers (“SNS”)(e.g. Facebook); each such account, a “Third Party Account”, via our Site as described below. As part of the functionality of the Site or Service, you may link your CXC Account with Third Party Accounts, by either: (i) providing your Third Party Account login information to CXC through the Site or Service or; or (ii) allowing CXC to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account. You represent that you are entitled to disclose your Third Party Account login information to CXC and/or grant CXC access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating CXC to pay any fees or making CXC subject to any usage limitations imposed by the applicable SNS. If you decide to register by logging into a Third Party Account via our Site, we will obtain the Personal Information you have provided to the applicable SNS from your Third Party Accounts and use that information to create your CXC Account and you will become a Member. If there is information about your “friends” or people with whom you are associated in your Third Party Account, the information we obtain about those “friends” or people with whom you are associated, may also depend on the privacy settings such people have with the applicable SNS.
We also collect the other information that you provide as part of registration and the administration and personalization of your CXC Account profile (e.g., without limitation, zip code (on its own) and individual preferences or demographic information) (“Non-Identifying Information”).
If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in every newsletter we sent you.
- Understand and save Members’ preferences for future visits.
- Compile aggregate data about site traffic and site interactions in order to offer better site experiences and tools in the future. We may also use trusted third party services that track this information on our behalf.
You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Internet Explorer) settings. Each browser is a little different, so look at your browser’s help menu to learn the correct way to modify your cookies.
If you disable cookies off, some features will be disabled and some of our Services will not function properly. However, you can still book the Services.
We honor do not track signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.
THIRD PARTY DISCLOSURE
We do not sell, trade, or otherwise transfer to outside parties your Personal Information unless we provide you with advance notice. This does not include website hosting partners and other parties who assist us in operating our Site, in facilitating and providing the Services on our behalf, or servicing you, so long as those parties agree to keep the Personal Information confidential and to not use it.
CXC may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect or defend the rights or property of CXC, (iii) investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or the public, violations of CXC’s Terms of Service, or (iv) protect against legal liability.
CXC may disclose your Personal Information with business partners with your consent. For example, but without limitation, if you elect to participate in a co-branded promotion, Personal and Non-Identifying Information that you may provide in that context will be shared as disclosed in the context of its collection.
CXC also may share Non-Identifying Information in its discretion. CXC may also disclose anonymous user statistics in order to describe the Services to current and prospective business partners and to other third parties for other lawful purposes.
However, CXC may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
Our Site is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.
We use regular malware scanning.
Your Personal Information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.
We implement a variety of security measures when a Member places an order to maintain the safety of your personal information.
All transactions are processed through a gateway provider and are not stored or processed on our servers.
However, no communications over the internet, or method of electronic storage, is 100% secure. Therefore, CXC cannot guarantee absolute security of your Personal Information and you should take special care in deciding what Personal Information you choose to provide.
THIRD PARTY LINKS
Occasionally, at our discretion, we may include or offer third party products or services on our Site. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our Site and welcome any feedback about these sites.
CHANGE OR DELETION OF YOUR INFORMATION
All Members may review, update, correct or delete the Personal Information in their registration profile by contacting us at firstname.lastname@example.org or editing the relevant part of their profile. If you would like us to cancel your CXC Account, please contact us or select the delete profile feature in the settings section and we will attempt to accommodate your request if we do not have any legal obligation or a legitimate business reason to retain the information contained in your CXC Account.
Pursuant to CXC’s terms of service you must be 18 years old or older to use the Services. In accordance with the Children’s Online Privacy Protection Act, we do not collect or maintain Personal Information directly from people we actually know are under 13 years of age. If we learn that a child under the age of 13 has directly submitted his or her Personal Information to the Site, we will take steps to remove that the child’s Personal Information from our databases.
INFORMATION WE COLLECT
You create or hold a chef account within ChefXChange. You can directly create menus and services within an account and you can request chef services using your account.
You create or hold a foodie account within ChefXChange. You can request chef service using your account.
Information we collect about you.
Contact Information (for example an email address): You might provide us with your contact information, whether through use of our services, a form on our website, an interaction with our customer support team.
Usage information: We collect usage information about you whenever you interact with our websites and services. This includes which webpages you visit, what you click on, when you perform those actions, and so on.
Device and browser data: We collect information from the device and application you use to access our services. Device data mainly means your operating system version, device type, system and performance information, and browser type.
User Preferences: We collect information such as page views, chef search history, booking history, cuisine preferences, service location, budget and so on.
Information from page tags: We use third party tracking services that employ cookies and page tags to collect data about visitors to our websites. This data includes usage and user statistics. Emails sent by ChefXChange include page tags that allow us to collect information about who opened those emails and clicked on links in them.
Referral information: If you arrive at a ChefXChange website from an external source (such as a link on another website or in an email), we record information about the source that referred you to us.
Information from third parties and integration partners: We collect your personal information or data from third parties if you give permission to those third parties to share your information with us or where you have made that information publicly available online.

Registration information: You need a ChefXChange account before you can use ChefXChange services. When you register for an account, we collect your first and last name, username, password and email address. If you choose to register by using a third party account (such as your Facebook account), please see “Information from third parties” below.
Profile data: When you sign up for our services you are asked to provide us with information about yourself and to give us more detailed insights into who you are.
HOW WE USE THE INFORMATION WE COLLECT
Page tags and web beacons: We collect information from page tags and web beacons to allow us to determine the success of our advertising campaigns. We also use page tags to allow the email sender to measure the performance of their email messaging and to learn how to improve email deliverability and open rates.
More details: We use this data to personalize online marketing campaigns to be relevant to you and your use of our services. By clearing your cookies in your browser settings you will no longer see personalized messages in this way but you continue to see ads over the internet that are not based on information you provided to ChefXChange.
Our primary goal is to improve upon and make sure our services and messaging are relevant for all our users, while also ensuring that personal information of all users is respected and protected.
Contact Information: We use contact information to respond to your inquiries, send you information as part of the services, and send you marketing information (for as long as you do not opt-out).
More details: We use your email address to send you marketing (newsletters), unless you indicate a preference to opt-out and for general updates on your account. You can opt out of marketing communications at any time by clicking on the “unsubscribe” link in them.
Reporting Purposes: We also use website visitor information such as page views, sessions and business data such as bookings information about paid, cancelled, completed bookings and so on to create and design stakeholder reporting and to enhance the performance of our service.
HOW YOU USE OUR SERVICES
We use information about how you use our services to improve our services for you and all users.
Device data: We use device data both to troubleshoot problems with our service and to make improvements to it.
More details: Device and browser data: We collect this to help us improve your service experience through a specific device/browser by optimizing how the website looks in a particular browser, how your screen brightness affects your experience and to ensure the service operates optimally and as it should on different devices and browsers.

Your Account Information: We need to use your account data to run your account, provide you with services, provide you with customer support, and contact you about your service or account. We occasionally send you communications of a transactional nature (e.g. service-related announcements, billing-related matters, changes to our services or policies, a welcome email when you first register). You cannot opt out of these communications since they are required to provide our services to you.
Information you share: Many of our services let you share information with others. Remember that when you share information publicly, it can be indexable by search engines. Our services provide you with different options on sharing and deleting your content but we cannot delete content from search engines so you need to be careful about information you make public.

If you use the “Remember me” feature when you sign into your account, we store your username in a cookie to make it quicker for you to sign in whenever you return to ChefXChange.

In addition to the above, we have implemented on our websites certain Google Analytics features that support Display Advertising, including re-targeting. You can choose to remove or disable cookies via your browser settings.
If you hold an account with ChefXChange we do not delete the data in your account – you are responsible for this data. There are controls in your account where you can terminate your account. Your data will remain on file with us however and if you would like us to delete it completely from our system. Please contact us at email@example.com to have the data deleted.
You can opt-out from direct marketing, we provide opt-out options in all direct marketing emails. Finally, if you do not wish to see personalized marketing content on the web related to our service you can clear the cookies in your browser settings.
